Marrion: I'm Marrion Cruz and I'm here to represent my client, John. We are trying to get his three young kids back to his custody, for his wife; Jane, are the kids' legal guardian, and my client doesn't even have the opportunity to see his kids. John works as a free-lance writer and makes just enough money for his rent and his kids' needs. My client has always been hands on with the children and is always the one going to meetings involving school. Although the court has given Kathy's client sole custody for the three children because of my client's alcohol abuse, he has since claimed to stop. Even though he's short in money from his job, he does get money still from his trust-fund established for him by his grandfather and also one from his parents. My client claims that Jane is almost always never home because of her job, and that she never necessarily takes time for the children. Is that right? You should chose my client to have shared custody for the children because he's a loving father that misses his three boys and won't let his old habits get in the way of the time he should be getting with his kids.
Kathy: I'm Kathy Yu, my client is Jane. She holds the sole custody of the three children that was mentioned before. We want to keep it that way, for John is an alcoholic, that's not good for the kids because he has the history of a bad temper that he cannot manage to control according to some witnesses, including the children. How can he hold his temper as he drinks? He claims he has stopped, but how are we so sure he's not going back to his old habits? My client, Jane, has a high paying job and provides everything needed for the children's education and their wants, with the rest going to bills and to the college funds that are for the children alone and cannot be touched until they graduate high school. My client do admit that she's busy with work, but doesn't believe that John is exaggerating that she's NEVER home. She does make time for the children. My client does have the history of depression, but that won't stop her for making time and loving her children. You should pick my client's side because she can manage for the kids, even without John's financial help. John's such an alcoholic, it won't be good for three under-aged children.
Ask the jury they're opinion on the case, on what they say.
Ask the judge if both the parents can share custody, if Jane shall get sole custody, or John gets sole custody.
